Freia Clinician Terms of Use
Effective Date: 28 January 2026
These Terms of Use ("Terms") govern your access to and use of the Freia platform ("Freia"), a clinical decision-support and behaviour-coaching tool provided by Freia Health Pty Ltd ("we", "us", "our").
By accessing or using Freia as a clinician, you agree to comply with these Terms and the Freia Privacy Policy, which forms part of these Terms.
1. Purpose of Freia
Freia is a clinical decision-support and behaviour-change platform designed to deliver nudges, education, and risk insights linked to treatment plans defined by you or your clinic.
Freia:
- is not a medical device,
- does not independently diagnose, treat, or prescribe, and
- does not replace clinical judgement.
You remain solely responsible for all clinical decisions, actions, and patient outcomes.
2. Your Responsibilities
As a clinician, you agree to:
- Use Freia only as a support tool, not as a substitute for professional judgement.
- Review, contextualise, and verify all AI-generated insights, nudges, scores, or recommendations before relying on them in patient care.
- Ensure all information entered into Freia (including pathology, questionnaires, notes, and uploads) is accurate, current, and clinically appropriate.
- Access patient data only where required for direct clinical care and within your authorised role.
- Maintain confidentiality and comply with all applicable privacy, health records, and clinic policies.
- Ensure emergency and acute-care pathways exist independently of Freia. Freia is not designed for urgent, emergency, or critical care.
- Maintain secure login credentials and notify Freia immediately of any suspected unauthorised access.
- Use Freia only within the clinic, organisation, or care setting licensed to access the platform.
3. Data Privacy, Access, and Governance
Freia processes personal health information ("PHI") in accordance with the Privacy Act 1988 (Cth), applicable health privacy laws, and the Freia Privacy Policy.
- Personal health information and clinical records are stored in Australian data centres using industry-standard encryption.
- Certain limited non-clinical personal information (such as authentication and access metadata) may be processed by trusted third-party service providers for secure platform operation, as described in the Privacy Policy.
- Audit logs may be maintained for safety, quality assurance, and compliance purposes.
Subject to law and clinic policy:
- you may request export or deletion of patient data,
- retention obligations may continue independently of platform access.
You grant Freia the right to use de-identified and aggregated data to improve algorithms, analytics, clinical insights, and platform performance.
You acknowledge that Freia insights may be limited by:
- the accuracy, completeness, or timeliness of data entered by clinicians or patients, and
- the availability or quality of third-party integrations.
4. Account Use
Your Freia account is personal and must not be shared.
Access may be revoked if:
- you leave your clinic or organisation,
- you no longer require clinical access, or
- there is misuse or suspected misuse of the platform.
Freia may suspend or terminate access for breach of these Terms or for security reasons.
5. Security and Availability
Freia takes reasonable steps to maintain platform security, encryption, and availability.
However:
- uninterrupted or continuous access is not guaranteed,
- Freia is not intended to replace EMR systems or mission-critical clinical infrastructure,
- you must ensure clinical operations can continue safely during any platform downtime.
6. Prohibited Use
You must not:
- Use Freia to independently diagnose, prescribe, or deliver care without appropriate clinical oversight.
- Use Freia outside your licensed clinic, organisation, or approved care setting.
- Attempt to reverse-engineer, copy, extract, or replicate Freia's algorithms, scoring systems, or software.
- Upload malicious code or interfere with platform security or performance.
- Misuse, disclose, or access patient information in breach of law or clinic policy.
- Treat third-party integrations (e.g. wearables, labs, OCR services) as substitutes for clinical assessment.
Freia is not responsible for inaccuracies arising from:
- third-party services or integrations, or
- incorrect, incomplete, or delayed data provided by clinicians or patients.
7. Intellectual Property
All intellectual property in Freia—including algorithms, insights, scoring systems, models, dashboards, software, documentation, and user experience—remains the exclusive property of Freia Health Pty Ltd.
You are granted a limited, revocable, non-transferable licence to use Freia solely for lawful clinical purposes within your clinic or organisation.
8. Support and Feedback
For technical support, contact: support@freia.com.au
Feedback may be used to improve Freia without obligation or compensation to you.
9. Limitation of Liability & Indemnity
Freia is provided "as is" as a clinical support tool.
To the extent permitted by law:
- Freia does not accept responsibility for clinical decisions, patient outcomes, or reliance on AI-generated insights.
- Freia's liability is limited to re-supplying access to the platform or refunding applicable fees (if any).
You agree to indemnify and hold Freia harmless from claims, losses, or damages arising from:
- your clinical decisions or omissions,
- your reliance on AI-generated or patient-entered data,
- your breach of these Terms, or
- your misuse of the Freia platform.
Nothing in these Terms excludes non-excludable rights under Australian law.
10. Changes to These Terms
Freia may update these Terms from time to time.
Material changes will be communicated via email or within the platform. Continued use of Freia constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of Queensland courts.
Acceptance
By continuing to use Freia as a clinician, you confirm that you have read, understood, and agreed to these Terms.
